Giancarlo Caselli, Chief Prosecutor of the Republic in Turin, explains in plain words why the hypothesis of the “short trial” proposed by Berlusconi is a colossal “porcata” to the detriment of honest citizens. ”On this problem of the so-called short-trial, first of all we need to say that there is great confusion: those who are promoting this project as a type of panacea for the ills of the justice system perhaps should square things up with the rules that discipline honest, truthful, correct publicity with the code for the self-discipline of the activity of advertising activity, because there’s talk of the short trial, but this is just, if not an illusion, an objective. In reality we need to put into the field whatever is necessary to arrive at this objective. Having said this to start off, more or less joking, let’s say straight away that it is our Constitution that demands that a trial has a reasonable duration. Then there’s the European Court of Human Rights that repeatedly has censured our country because the trials are too long and then that the trial has to be short is sacred, it is in the Constitution and it is what Europe is telling us.
How can you not agree with a short trial? It’s like a doctor not being in agreement with a medicine that abolishes cancer. But it’s not enough to say “short trial”, it’s not enough to proclaim an intention, more is needed. First of all it’s necessary that the reform is evaluated as regards its effects on the general picture of trials, without having exclusive or prevalent reference to this or that trial that is relevant to someone, otherwise if that were the case – and it could be like that, when you read the newspapers – it is Herod’s technique: kill two trials with the slaughter of the innocents, that is of trials that with this or that, that is of interest to a particular person, are absolutely irrelevant. Why do I say the slaughter of the innocents? Because in reality – and we will see – it’s not a matter of shortening the duration of the trial, but to put at risk of their lives, at risk of being assassinated, killed, many many trials. The main problem is that a sacred objective is fixed like the “short trial” , then there’s the need to take on board how to reach that objective and try to reduce, if not eliminate the causes of the excessive duration.
The trial lasts too long because of the great amount of work on the shoulders of the magistrates. In the last few years it has increased in an incredible way: the citizen is ever more aware of his rights, and ever more frequently, he turns to the justice system to get his rights protected and this determines an explosion in the number of cases. Let’s consider the case of medical malpractice: once upon a time, you went to hospital and if things didn’t go well, it finished there. Now, if things don’t go well or if it is considered that things didn’t go well, there’s no sick person or relative of a sick person who doesn’t sue the doctor or the hospital. The trials for medical malpractice have become a really important number of trials. In the meantime, the number of magistrates has not gone up proportionally.

The whole justice system needs re organized in italy any way. maybe, just maybe, berlusca has a point in all of this nonsense.
he is only doing this to get himself off the hook but on a theoretical level he has a point. the justice system in italy is $hite. with a capital "$".
