L'unica soluzione è una Class Action.
Anche se quella attivata non corrisponde alla vera class action, però qualcosa si può fare anche con questa.
Quindi invito gli avvocati che leggono questo post a prendersi questo tipo di incarico. Per loro sarebbe un bel trampolino di lancio verso la notorietà.
Inoltre invito a contattare i nostri avvocati del MoVimento per vedere se hanno voglia di attivare una class action per il rimborso dell'IVA.

Non ho fatto la domanda di rimborso proprio perchè sapevo che avrebbero trovato un trucco per non pagarlo.
La classe politica è al servizio degli interessi economici e delle clientele trasversali e insieme sono imbattibili. L'unico modo per combatterle veramente è quello di eroderle dal basso, distruggendo i loro orticelli locali che gli forniscono il pane quotidiano: lavoro in cambio di voti, discriminazioni e illegalità che costringono a chiedere favori per avere giustizia, speculazione edilizia che cementifica e distrugge, salute negata che più la gente muore e più si erogano finanziamenti che finiscono nelle tasche della criminalità organizzata.
Purtroppo ho visto tanti ex giovani che criticavano questo sistema, entrare a farne parte non appena gli veniva offerto un pezzo della torta. La prova che niente è cambiato è che tutte le mie denunce, a tutti i partiti, sindacati e associazioni, restano sempre senza risposta. Non resta che rassegnarsi o scappare.

Ciao a tutti. Credo che solo nei comuni dove la TIA non veniva calcolata correttamente (ovvero una quota fissa per mq ed una variabile in funzione del numero componenti il nucleo famigliare o della tipologia di attività svolta nei locali, ecc.) un giudice può dire che sopravvive la tassa rifiuti.

Solo quest'ultima non è assoggettabile ad iva. Siccome però il servizio svolto da ditte di raccolta rifiuti per conto dei comuni deve essere fatturato con iva al 10%, questo per il cittadino è un costo.

Oggi la ditta che emetteva le bollette questa iva la fatturava a parte. In futuro è probabile che la ricomprenda nei costi così da non doverla più esporla separatamente.

L'iva c'è sempre, non la vedremo più.

L'unico caso in cui non c'è IVA è quando il comune effettua la raccolta rifiuti in modo diretto e direttamente emette le cartelle di pagamento.

Il decreto Ronchi prima e quello Ambientale oggi (D.Lgs. 152/06 e smi)prevedono la TIA per tutti e prevedono che il servizio raccolta rifiuti venga svolto in regime di concorrenza da ditte private.
Se non oggi, in futuro dovremo pagare tutti l'iva.
